IPID: Draft Regulations Gazetted for Comment

Brought to you by SA Legal Academy: The Department of Police has issued a notice calling for public input on draft regulations issued in terms of the Independent Police Investigative Directorate Act, No. 1 of 2011.

The proposed regulations, published on the Independent Police Investigative Directorate (IPID) website, are intended to repeal and replace the existing regulations promulgated in February 2012. This regulatory overhaul follows the commencement of most sections of the Independent Police Investigative Directorate Amendment Act, No. 27 of 2024, which came into effect in August 2025.

The primary objective of the 2024 Amendment Act and these subsequent draft regulations is to align the principal statute with the 2016 Constitutional Court ruling in McBride v Minister of Police and Another. This ruling necessitated legislative changes to ensure IPID’s institutional and operational independence from executive interference, while providing for enhanced parliamentary oversight.

Key Regulatory Focus Areas

The draft regulations address several procedural and administrative frameworks necessitated by the 2024 amendments, including:

  • Appointment procedures for the Executive Director to ensure independence;
  • Conditions of service and disciplinary processes for IPID officials;
  • Operational reporting requirements to Parliament; and
  • Administrative forms and filing procedures for investigations and oversight.

Interested parties and stakeholders have until 24 December 2025 to submit written comments on the draft regulations. It should be noted that while the Government Gazette notice references specific draft forms, these were not available at the time of the initial publication.
