Environmental Management: Proposed Generic EMPr for Prince Edward Islands
Brought to you by SA Legal Academy: The Department of Forestry, Fisheries & the Environment (DFFE) has published a notice calling for public input on the proposed adoption of a generic environmental management programme (EMPr) for the Prince Edward Islands.
In terms of the National Environmental Management Act, No. 107 of 1998 (NEMA), the proposed programme aims to streamline environmental compliance for conservation purposes and related scientific research. Once finalised, the regulations will exclude certain activities from the requirement to obtain a formal environmental authorisation under NEMA, provided such activities are conducted in accordance with the adopted generic EMPr.
The proposed framework includes:
- Procedures for the registration of activities intended for the Prince Edward Islands;
- Specific timeframes for the processing of applications by the Department;
- Compliance requirements for research and conservation bodies operating within the protected area; and
- Exclusion criteria for activities that would otherwise trigger the need for a full Environmental Impact Assessment (EIA).
The notice provides for an extended commentary period to account for the festive season break between 15 December 2025 and 5 January 2026. Interested and affected parties have until 21 January 2026 to submit written representations or comments to the Department.
