Brought to you by SA Legal Academy: The National Assembly’s Portfolio Committee on Co-operative Governance & Traditional Affairs has issued a call for written submissions regarding the Intergovernmental, Monitoring, Support & Interventions Bill.

Following the tabling of the Bill in April 2025, the Committee is seeking public comment to inform parliamentary hearings scheduled for 2026. The proposed legislation aims to regulate the processes by which national and provincial governments monitor, support, and intervene in the affairs of provinces and municipalities, respectively. This framework is intended to provide a uniform procedure for interventions as contemplated in sections 100 and 139 of the Constitution of the Republic of South Africa, 1996.

Once enacted and operationalised, the Bill will establish clear criteria and procedures for:

  • Monitoring the performance of provinces and municipalities in fulfilling their executive obligations;
  • Providing targeted support to struggling administrations before an intervention is triggered;
  • Executing formal interventions when constitutional or statutory obligations are not met; and
  • Terminating interventions once the relevant objectives have been achieved.

Stakeholders and interested parties are required to submit their written representations by no later than 23 January 2026. This deadline precedes the formal public hearing phase, where oral submissions may be invited based on the written content received.
