In terms of the public participation mandates set out in the Constitution of the Republic of South Africa, 1996, various state departments have published notices in the Government Gazette inviting stakeholders to submit written representations on proposed policy changes and draft bills. These opportunities for engagement allow legal and compliance professionals to influence the regulatory trajectory of their respective industries before draft provisions are enacted into law.
Stakeholders should note that each notice carries specific procedural requirements for submissions, including:
- Strict adherence to the closing dates specified in the relevant Government Gazette notice.
- Directing comments to the designated departmental official or parliamentary committee.
