Local Government: Draft Planning and Performance Management Regulations
Brought to you by SA Legal Academy: The Department of Co-operative Governance & Traditional Affairs (CoGTA) has invited public comment on draft amendments to the planning and performance management regulations issued under the Local Government: Municipal Systems Act, No. 32 of 2000.
In terms of the Local Government: Municipal Systems Act, No. 32 of 2000, the proposed amendments seek to align the existing regulatory framework with the Local Government: Municipal Systems Amendment Act, No. 3 of 2022. Most provisions of the 2022 Amendment Act have been in operation since November 2022, necessitating an update to the regulations originally promulgated in August 2001.
The draft regulations introduce a revised framework for municipal performance monitoring and measurement. Key changes include:
- The introduction of new general key performance indicators (KPIs) for municipalities;
- A structured framework for monitoring and measuring municipal performance; and
- Provisions empowering the Minister to delay the implementation of specific reporting requirements where practical constraints exist.
The Department has requested that all written inputs and comments on the draft amendments be submitted by 26 January 2026. Once finalised, these regulations will materially alter the compliance landscape for municipal performance reporting and internal auditing processes.

- For your clients: Municipal clients and municipal entities will be required to update their internal performance management systems and reporting structures to comply with the revised general KPIs and reporting deadlines.
