DTIC Calls for Public Comment on Five B-BBEE Scorecard Statements

Brought to you by SA Legal Academy: The Department of Trade, Industry & Competition (DTIC) has gazetted notices requesting public comment on proposed amendments to five scorecard code statements and the schedule of related interpretations and definitions.

In terms of the Broad-based Black Economic Empowerment Act, No. 53 of 2003, as amended by the Broad-based Black Economic Empowerment Amendment Act, No. 46 of 2013, these proposed changes aim to update the regulatory framework governing transformation metrics. The notices set a deadline for written representations and input by 30 March 2026.

The scope of the proposed amendments includes:

  • Revisions to five specific scorecard code statements within the B-BBEE Codes of Good Practice;
  • Amendments to the schedule of interpretations and definitions used to calculate compliance; and
  • Alignment with revamped transformation fund proposals currently under development by the DTIC.

Once finalised and enacted, these revised statements will govern how measured entities report on their empowerment progress and how verification agencies assess scorecard elements. The lengthy consultation period suggests a significant lead time for businesses to prepare for the transition to the updated standards.
