Road Accident Fund: Claims Limit Adjusted for January 2026
Brought to you by SA Legal Academy: The Road Accident Fund (RAF) has announced the quarterly adjustment to the statutory limit for loss of income and support claims.
In terms of section 17(4)(c) of the Road Accident Fund Act, No. 56 of 1996, the statutory limit for claims relating to loss of income and loss of support has been adjusted to R378 581.00. This new limit is scheduled to come into force on 31 January 2026.
The adjustment is issued via Government Gazette notice and is calculated using a specific formula intended to counter the effects of consumer price index (CPI) inflation. These statutory adjustments occur quarterly to ensure the cap on compensation for loss of support or income remains current with economic shifts.

- For yourself: No direct individual obligations; impact is channelled through legal representation in the event of a personal injury claim against the Fund.
- For your business: Legal practices and actuarial firms must update their quantum calculation models and internal compliance checklists to reflect the adjusted cap of R378 581.00 for claims arising during the applicable period.
- For your clients: Claimants seeking compensation for loss of income or support will have their potential recovery capped at the new statutory limit of R378 581.00 for accidents occurring on or after 31 January 2026.
