Sutherland Astronomy Advantage Area: Proposed Mining Restrictions

Brought to you by SA Legal Academy: In terms of the Astronomy Geographic Advantage Act, No. 21 of 2007, the Department of Science & Technology has issued a notice proposing to expand the list of prohibited mining activities in the Sutherland Central Astronomy Advantage Area, Northern Cape.

The proposed regulations seek to prohibit exploration and prospecting activities within the designated area to ensure optimal conditions for astronomy and related scientific endeavours. This expansion follows the regulatory framework established in May 2019, which already prohibits the following activities in the Sutherland Central Astronomy Advantage Area:

  • Open cast mining;
  • Mining dumps at ground level; and
  • Hydraulic fracturing (fracking).

Stakeholders and interested parties have until 24 March 2026 to submit input and comments regarding the proposed prohibitions. The Sutherland area is home to a critical observatory established in 1973 and requires stringent environmental protections to maintain its scientific utility. This initiative is distinct from the MeerKAT telescope and the Square Kilometre Array (SKA) project located near Carnarvon, though it shares the broader objective of protecting South Africa’s astronomy geographic advantages.
