Deeds Registries Act, 1937: Fee Regulations Amended
Brought to you by SA Legal Academy: The Department of Agriculture, Land Reform & Rural Development has gazetted amendments to the regulations under the Deeds Registries Act, No. 47 of 1937, revising the schedule of fees for office services.
In terms of section 10 of the Deeds Registries Act, No. 47 of 1937, the Minister has amended the regulations relating to the fees of office. These amendments affect a comprehensive range of services rendered by the Deeds Office, including the registration of deeds, the provision of information, and the processing of various applications.
The amended fees are scheduled to come into effect one month from the date of publication in the Government Gazette. Practitioners and stakeholders are required to apply the new fee schedule to all relevant transactions lodged on or after the effective date.
Key affected services
- Registration of transfers and mortgage bonds.
- Issuing of certificates of registered title.
- Provision of deeds office information and copies of records.
- Processing of notarial deeds and miscellaneous applications.
What this means for you, your business, or your clients
- For yourself: Ensure that all pro-forma accounts and fee calculations for conveyancing matters are updated to reflect the new gazetted rates to avoid shortfalls in disbursements.
- For your business: Update internal accounting systems and document management templates to incorporate the revised fee schedule before the one-month implementation deadline.
- For your clients: Advise clients on the increased costs associated with property transfers and bond registrations, particularly for transactions expected to lodge after the new fees take effect.
