Draft Amendments to Uniform Rule 53: Review Proceedings
Brought to you by SA Legal Academy: In terms of the Rules Board for Courts of Law Act, No. 107 of 1985, the Department of Justice & Constitutional Development has issued a notice calling for public comment on draft amendments to Uniform Rule 53.
The proposed amendments concern the procedure for the review of decisions or proceedings of any lower court and of any tribunal, board, or officer performing judicial, quasi-judicial, or administrative functions. The Rules Board for Courts of Law has set a deadline of 31 March 2026 for the submission of written input regarding these changes.
The draft rule explicitly excludes certain matters from its scope. According to the notice, the amended rule would not apply when bringing under review any decision or judgment in criminal proceedings. The focus of the amendment is to streamline the process by which administrative and quasi-judicial actions are challenged in the High Court.
Key aspects of the draft amendments
- The rule applies to proceedings of lower courts, tribunals, and boards.
- It covers officers performing judicial, quasi-judicial, or administrative functions.
- Criminal proceedings are specifically excluded from the application of the amended rule.
- Stakeholders have until 31 March 2026 to submit comments to the Rules Board.
What this means for you, your business, or your clients
- For yourself: You must review the draft text of Uniform Rule 53 to determine how the proposed procedural changes will affect your litigation strategy in administrative law matters and ensure any comments are submitted by the 31 March 2026 deadline.
- For your business: Law firms and compliance departments should update their internal litigation manuals and standard operating procedures for review applications to align with the proposed procedural requirements for administrative and quasi-judicial reviews.
- For your clients: Clients involved in disputes with administrative bodies or lower courts will need to be advised on the potential changes to the timeline and record-filing requirements for review proceedings, excluding criminal matters.
