Gas Bill formally tabled in Parliament

Brought to you by SA Legal Academy: The Gas Bill was formally tabled in Parliament on 5 March 2025, initiating the legislative process to repeal and replace the existing regulatory framework for the gas sector.

In terms of the parliamentary papers published on 5 March 2025, the Gas Bill has been introduced to the National Assembly. Once passed and operationalised, the new legislation will repeal the Gas Act, No. 48 of 2001. The Bill follows the publication of an explanatory summary and prior approval by Cabinet, aiming to modernise the legal oversight of South Africa’s gas industry in line with current market dynamics.

The Gas Bill seeks to achieve several regulatory objectives, including:

  • Promoting the efficient development of the gas industry to support national economic growth;
  • Facilitating increased investment in gas infrastructure;
  • Ensuring competitive pricing and supply within the domestic market; and
  • Addressing technological developments, particularly in the areas of gas transportation and storage.

The Bill is expected to have been informed by public commentary received on the draft Gas Amendment Bill released in January 2024. The proposed framework will govern how gas is transported, stored, and traded, impacting both upstream and downstream participants. It specifically targets the modernisation of provisions dealing with gas transportation and storage infrastructure.
