National Petroleum Company Bill Tabled in Parliament

Brought to you by SA Legal Academy: The National Petroleum Company Bill has been formally tabled in Parliament to provide a legislative framework for the state-owned entity tasked with energy exploration, production, and infrastructure management.

The National Petroleum Company Bill follows the release of a draft version for public comment in November 2023. The legislation seeks to formally constitute the South African National Petroleum Company (SANPC), an entity intended to ensure the security of energy supply through direct participation in the petroleum value chain.

In terms of the memorandum on the Bill’s objects, the SANPC will be empowered to:

  • Develop, participate in, operate, and acquire energy infrastructure, including transmission pipelines;
  • Participate in exploration and production operations; and
  • Manage the strategic transition of energy assets within the state’s portfolio.

The Bill further contains substantive transitional arrangements. These provisions govern the legal transfer of human resources and assets from existing state entities to the SANPC, ensuring continuity of operations during the consolidation of the state’s petroleum interests.
