NPA Amendment Act: Section 8 Commencement Date Gazetted

Brought to you by SA Legal Academy: The Department of Justice and Constitutional Development has gazetted the commencement date for section 8 of the National Prosecuting Authority Amendment Act, No. 10 of 2024, which establishes an independent oversight mechanism for investigators.

In terms of a notice gazetted by the Department of Justice and Constitutional Development, section 8 of the National Prosecuting Authority Amendment Act, No. 10 of 2024 will come into operation on 1 March 2026. While the majority of the Amendment Act’s provisions came into force in August 2024, the implementation of the complaints mechanism was deferred to allow for regulatory adjustments.

Section 8 of the 2024 Amendment Act inserts section 22A into the National Prosecuting Authority Act, No. 32 of 1998. This new section provides for the appointment of a retired judge to exercise oversight over investigators within the National Prosecuting Authority (NPA). The gazetted notice includes a schedule of amended regulations required to operationalise this office.

The oversight mechanism is designed to process complaints and evidence regarding the conduct of investigators. In accordance with sub-sections 7(a) and (b) of the principal statute, the retired judge will be empowered to:

  • Hear formal complaints from designated persons regarding the conduct of NPA investigators;
  • Receive and evaluate evidence submitted in support of such complaints; and
  • Enhance the overall accountability of the NPA’s investigative functions.

What this means for you, your business, or your clients

  • For yourself: No direct individual filing requirement; however, legal practitioners should note the 1 March 2026 effective date to advise on the availability of a formal judicial oversight channel for investigator misconduct.
  • For your business: Law firms and compliance departments should update internal protocols for managing NPA interactions to include the section 22A complaints procedure as a formal recourse mechanism for investigative irregularities.
  • For your clients: Clients involved in NPA-led investigations will gain a statutory right to lodge formal complaints with a retired judge regarding investigator conduct once the mechanism becomes operational in 2026.
