COIDA: Regulatory Amendments Gazetted to Implement 2022 Amendment Act
Brought to you by SA Legal Academy: The Department of Employment & Labour has gazetted four sets of amendments to regulations under the Compensation for Occupational Injuries & Diseases Act, No. 130 of 1993 (COIDA).
These amendments, which are immediately in force, are designed to give practical effect to specific provisions of the Compensation for Occupational Injuries & Diseases Amendment Act, No. 10 of 2022. This follows the commencement of most sections of the 2022 Amendment Act in January 2026.
The regulatory changes provide the necessary framework for the administration of claims and benefits as updated by the primary legislation. The amendments focus on aligning procedural requirements with the expanded scope of the Act, which now includes domestic workers and refined definitions for occupational diseases.
Key Regulatory Focus Areas
- Administrative procedures for filing and processing claims under the amended legislative framework;
- Compliance requirements for employers regarding the notification of occupational diseases;
- Updated protocols for medical assessments and the submission of medical reports to the Compensation Fund; and
- Refined criteria for the assessment of permanent disablement and the calculation of benefits.
