Economic Regulation of Transport Amendment Bill Signed into Law
Brought to you by SA Legal Academy: In terms of the **Economic Regulation of Transport Act, No. 6 of 2024**, the President has signed an amendment bill into law to rectify technical errors in the principal statute’s schedules.
The amendment, which was passed by Parliament in December 2025, specifically corrects an error in Schedule 1 of the **Economic Regulation of Transport Act, No. 6 of 2024**. Once fully operational, this legislative framework will establish two parallel, independent, but integrated regulatory agencies responsible for the economic oversight of South Africa’s road, rail, port, and aviation services.
Implementation of the principal statute is governed by a presidential proclamation gazetted in November 2024, which mandates a phased commencement:
- Specific sections and chapters of the Act came into effect on 1 April 2025.
- The remaining provisions are scheduled to come into force on 1 April 2026.
What this means for you, your business, or your clients
- For yourself: No direct individual obligations; professional impact is limited to the requirement to maintain technical knowledge of the shifting regulatory oversight in the transport sector.
- For your business: Firms providing logistics or transport services must update their compliance calendars to prepare for the full implementation of the new integrated regulatory agencies by 1 April 2026.
- For your clients: Clients in the aviation, maritime, rail, and road sectors must review their current operational frameworks against the corrected Schedule 1 to ensure alignment with the 2024 Act’s requirements.
