Legal Practice Council: Misconduct Rule Amendments

Posted 13 March 2026 Written by Acts Online

Brought to you by SA Legal Academy: The Legal Practice Council (LPC) has implemented immediate amendments to the rules governing misconduct and disciplinary procedures for legal practitioners.

In terms of section 95(1) of the Legal Practice Act, No. 28 of 2014, the Council has gazetted revisions to the Rules of the South African Legal Practice Council. These amendments refine the regulatory framework for misconduct, specifically addressing the procedural requirements for disciplinary inquiries and the professional standards expected of attorneys and advocates.

The revised rules are effective immediately from the date of publication in the Government Gazette. Legal practitioners are required to align their professional conduct with these updated provisions to ensure compliance with the statutory requirements of the Council.

What this means for you, your business, or your clients

  • For yourself: You must review the amended misconduct definitions to ensure your professional conduct and interactions with the Council remain compliant with the updated Legal Practice Act rules.
  • For your business: Legal practices must update internal compliance manuals and risk management protocols to reflect the revised disciplinary procedures and misconduct standards.
  • For your clients: No direct individual obligations; clients benefit from a clarified regulatory framework regarding the oversight and discipline of legal practitioners.
