SAPO Reserved Postal Services Licence Renewal: ICASA Calls for Comment
Brought to you by SA Legal Academy: The Independent Communications Authority of South Africa (ICASA) has initiated a public consultation process regarding the renewal of the South African Post Office’s (SAPO) 25-year reserved postal services licence.
In terms of the Independent Communications Authority of South Africa Act, No. 13 of 2000, and the Postal Services Act, No. 124 of 1998, ICASA has gazetted a notice calling for written representations by 23 April 2026. This follows the expiry of SAPO’s original 25-year licence on 31 March 2025, for which a renewal application was submitted prior to the deadline.
The renewal process occurs amidst a regulatory review of SAPO’s ‘exclusive’ right to provide reserved postal services. In March 2025, a supplementary review was launched focusing on the monopoly held by the national carrier. Subsequently, the Minister of Communications & Digital Technologies, Solly Malatsi, issued a directive to ICASA to consider the following:
- The potential termination of SAPO’s exclusivity over reserved postal services;
- The impact of allowing private couriers to legally handle items weighing less than 1kg; and
- The broader reform of the postal sector to ensure sustainability and competition.
The current ICASA notice specifically addresses the licence renewal application but does not explicitly reference the Ministerial directive or the parallel process regarding the removal of exclusivity. The ICASA Amendment Act, No. 3 of 2006, which transferred postal regulatory functions to ICASA, provides the framework for this alignment of the 2001 licence with current statutory requirements.
