Brought to you by SA Legal Academy: The Special Pensions Amendment Bill [B11-2024] has been formally introduced in Parliament to address implementation misalignments within the Special Pensions Act, No. 69 of 1996.

In terms of the memorandum on the objects of the Bill, the proposed amendments seek to resolve procedural and substantive misalignments identified by the Government Pensions Administration Agency (GPAA) during the administration of the 1996 Act. The Special Pensions Act, No. 69 of 1996 provides non-contributory benefits to individuals who made sacrifices or served the public interest in establishing a democratic constitutional order in South Africa.

The Bill follows the recent publication of a procedurally required pre-tabling explanatory summary. As these pensions are non-contributory benefits funded by the National Treasury and administered by the GPAA, the Bill aims to refine the criteria for “deserving applicants” and ensure the legislative framework aligns with current administrative practices.
