Waste Management: Draft Exemption Application Regulations Published for Comment
Brought to you by SA Legal Academy: The Department of Forestry, Fisheries & the Environment has released draft regulations governing the application process for exemptions under the national waste management framework.
In terms of the National Environmental Management: Waste Act, No. 59 of 2008, the Minister has called for public comment on draft regulations that prescribe the procedure for applying for exemptions from the provisions of the Act. The proposed framework aims to standardise the administrative processing of such applications, ensuring consistency in how the regulatory authority handles requests for relief from statutory obligations.
Key Procedural Requirements
- Application Procedures: Detailed steps for submitting exemption requests, including the specific information and documentation required by the Department.
- Processing Timeframes: Defined periods within which the Department must acknowledge, review, and issue a decision on an application.
- Public Consultation: A mandatory requirement for applicants to conduct public participation processes before an exemption can be considered.
Stakeholders and interested parties have until 10 April 2026 to submit written representations or comments on the draft regulations to the Department of Forestry, Fisheries & the Environment.
What this means for you, your business, or your clients
- For yourself: No direct individual obligations; professional awareness is required to advise on the shifting administrative requirements for environmental permits and exemptions.
- For your business: Environmental consultancy and legal firms must update their compliance templates to account for the specific timeframes and public participation steps mandated in the draft regulations.
- For your clients: Entities seeking exemptions from waste management licenses or standards must prepare for increased procedural rigour and the potential for public opposition during the mandatory consultation phase.
