CIPC Issues Compliance Checklist Report for Non-Profit Companies

Brought to you by SA Accounting Academy: The Companies and Intellectual Property Commission (CIPC) has issued the Compliance Checklist Report for Non-Profit Companies (NPCs) to address governance and financial management trends.

In terms of the Companies Act, No. 71 of 2008, the CIPC monitors compliance through the mandatory Compliance Checklist. The latest report focuses on the rapid growth of religious organizations registered as NPCs, noting that the number of charismatic churches registered as NPCs increased from 22 in 2010 to 261 by 2024.

The CIPC identifies these entities as particularly susceptible to mismanagement. This vulnerability stems from the high level of public trust they command and their significant dependence on voluntary financial contributions. The report underscores the necessity for strict adherence to the governance requirements set out in the Companies Act, specifically regarding:

  • The fiduciary duties of directors in the non-profit sector;
  • The transparent management of financial contributions; and
