Brought to you by SA Legal Academy: The Department of Human Settlements has released the draft Prevention of Illegal Eviction from & Unlawful Occupation of Land Amendment Bill for public comment, seeking to refine the regulatory framework governing land invasions and building occupations.

In terms of the Prevention of Illegal Eviction from & Unlawful Occupation of Land Act, No. 19 of 1998 (the PIE Act), the proposed amendments are intended to empower municipalities, state entities, and private property owners to respond more decisively to unlawful occupations. The Department has invited stakeholders to submit written input on the draft Bill by 15 June 2026.

The draft legislation aims to address existing ambiguities within the principal statute, specifically regarding the procedural requirements that must be satisfied to effect a lawful eviction.
