Enactment of Public Administration, Public Service, and Marine Oil Pollution Acts
Brought to you by SA Legal Academy: The Public Administration Management Amendment Act, the Public Service Amendment Act, and the Marine Oil Pollution (Preparedness, Response & Co-operation) Act have been signed into law, though their specific commencement dates are yet to be proclaimed in the Government Gazette.
The Public Administration Management Amendment Act (amending Act No. 11 of 2014) seeks to address challenges experienced in implementing the principal statute. These challenges largely stem from procedural complications related to regulating associated fiscal arrangements and the transfer and secondment of employees within the public administration.
The Public Service Amendment Act (amending the Public Service Act, No. 103 of 1994) introduces measures to professionalise the public service. Key objectives include:
- Clarifying the roles and responsibilities of executive authorities and heads of department;
- Devolving administrative powers to heads of department;
- Enhancing the separation of political and administrative functions; and
- Providing for the role of the Director-General in the Presidency as the head of the public service.
The Marine Oil Pollution (Preparedness, Response & Co-operation) Act establishes a national framework for South Africa to fulfill its obligations under the International Convention on Oil Pollution Preparedness, Response and Co-operation, 1990. The Act facilitates collaboration between the state and affected parties in preparing for and responding to oil spills at sea.
