National Treasury: Draft General Public Procurement Regulations
Brought to you by SA Accounting Academy: National Treasury has released the draft General Public Procurement Regulations for public consultation, marking a significant step toward the full implementation of the Public Procurement Act.
In terms of section 63(3) of the Public Procurement Act, No. 28 of 2024, the Minister of Finance has published the draft General Public Procurement Regulations, 2026 for public comment. These regulations, contained in Government Gazette No. 54528, are intended to provide the necessary procedural and administrative framework for the operationalisation of the Act. The 102-page draft document outlines the comprehensive standards and processes that will govern how all organs of state, including national and provincial departments, municipalities, and public entities, must conduct procurement activities.
The draft regulations address several critical areas required by the Public Procurement Act, No. 28 of 2024, including:
- The operational functions and institutional arrangements of the Public Procurement Office and provincial treasuries.
- The standardisation of procurement methods and the conditions under which specific methods may be utilised.
- Procedures for the invitation, submission, and evaluation of bids, including the use of electronic procurement systems.
- The framework for preferential procurement, including the application of set-asides and pre-qualification criteria for designated groups.
- Mechanisms for dispute resolution, including the process for lodging complaints and the functions of the Public Procurement Tribunal.
- The debarment of suppliers found to have engaged in prohibited practices or poor performance.
The implementation of the Public Procurement Act, No. 28 of 2024 is contingent upon the finalisation and promulgation of these supporting regulations. According to the National Treasury, the regulations will take effect on a date to be determined by the Minister in terms of section 63(5) of the Act, following the conclusion of the public consultation and parliamentary oversight processes.
