Draft Public Procurement Tribunal Regulations Published
Brought to you by SA Accounting Academy: National Treasury has released the draft Public Procurement Tribunal Regulations for public comment, marking a significant step in the implementation of the new national procurement framework.
In terms of section 63(3) of the Public Procurement Act, No. 28 of 2024, these draft regulations were published in Government Gazette No. 54527. The regulations provide for the procedural and administrative matters necessary for the operation of the Tribunal established under section 36 of the Act. The Tribunal is an essential component of the new procurement regime, as it must be fully established before the Act and the General Public Procurement Regulations can be brought into full effect.
The draft regulations prescribe the framework for the Tribunal’s functions, including:
- The formal procedures for lodging applications for review of procurement decisions;
- The administrative requirements for the management of proceedings and hearings;
- The rules governing the submission of evidence and documentation to the Tribunal; and
- General procedural matters necessary to ensure the Tribunal can exercise its powers under section 36.
The Public Procurement Act, No. 28 of 2024 seeks to create a single regulatory framework for public procurement in South Africa. The Tribunal serves as an independent review mechanism to adjudicate disputes arising from procurement processes, providing a specialized alternative to traditional litigation. According to the notice, the regulations will take effect on a date to be determined in terms of section 63(5) of the Act. Stakeholders were invited to submit written comments on the draft by 15 May 2026.
