Employment Services Amendment Bill Set for Tabling in Parliament
Brought to you by SA Legal Academy: The Department of Employment and Labour has gazetted a notice announcing the imminent tabling of the Employment Services Amendment Bill in Parliament, following its approval by Cabinet in May 2025.
In terms of the procedurally required pre-tabling explanatory summary published alongside the notice, the proposed legislation introduces critical amendments to the Employment Services Act, No. 4 of 2014. The primary objective of the Amendment Bill is to regulate the employment of foreign nationals in South Africa within the domestic labour market framework.
The proposed amendments seek to address shifting labour market dynamics by introducing structured regulatory oversight. Specifically, the Bill aims to achieve the following core objectives:
- Empower the Minister of Employment and Labour to establish sector-specific, occupational, and location-specific quotas for the employment of foreign nationals.
- Provide a clear statutory framework for the employment of foreign workers while prioritizing the employment of South African citizens.
- Strengthen compliance and enforcement mechanisms across affected industries.
The publication of the explanatory summary follows Cabinet’s approval of the Bill in May 2025, marking the final procedural step before the draft legislation is formally introduced and debated in Parliament.
