President Receives Second Madlanga Commission Interim Report
Brought to you by SAnews: President Cyril Ramaphosa has formally received the second interim report of the Commission of Inquiry into Criminality, Political Interference, and Corruption in the Criminal Justice System.
The commission, widely known as the Madlanga Commission, was established to investigate serious allegations of systemic criminality, political interference, and corruption within South Africa’s criminal justice structures. The inquiry was initiated following specific allegations tabled by KwaZulu-Natal Provincial Commissioner Lieutenant-General Nhlanhla Mkhwanazi on 6 July 2025.
In terms of its established terms of reference, the Commission is empowered and expected to refer any conduct that points to criminal acts directly to the appropriate law enforcement agencies and the National Prosecuting Authority (NPA) for prosecution. President Ramaphosa is currently studying the interim report’s findings while the Commission’s formal investigative proceedings remain ongoing.
What this means for you, your business, or your clients
- For yourself: No direct individual compliance obligations arise from this interim stage, but legal professionals should monitor the proceedings for potential precedents regarding political interference and state liability.
- For your business: Professional firms handling public sector litigation or criminal defense should prepare for potential shifts in prosecution strategies as the Commission begins referring matters to the NPA.
- For your clients: Advise corporate and public sector clients to maintain rigorous governance records, as the ongoing investigations signal heightened scrutiny and a lower threshold for direct criminal referrals by state commissions.
