Brought to you by SAnews: National Treasury has announced an extension of the public comment period for the draft General Public Procurement Regulations, 2026, to 15 July 2026.

In terms of section 63(1) of the Public Procurement Act, No. 28 of 2024, the Minister of Finance originally published the draft regulations for public comment in Government Gazette No. 54528 on 16 April 2026. The initial comment window was set for 60 days from the date of publication. However, recognizing the complexity of the regulatory framework, the Minister has granted an additional 30-day extension.

The draft General Public Procurement Regulations, 2026, are designed to implement the Public Procurement Act, No. 28 of 2024, which was assented to by the President on 18 July 2024 and gazetted on 23 July 2024. The Act aims to establish a single, unified regulatory framework for public procurement across all organs of state in South Africa.

Interested parties and compliance professionals must submit written comments on the draft regulations on or before the revised deadline of 15 July 2026. Submissions must be emailed to [email protected].

The draft regulations and accompanying notices can be accessed on the National Treasury website at https://www.treasury.gov.za/legislation/regulations/default.aspx.

What this means for you, your business, or your clients

  • For yourself: Use the extended period to review the draft regulations to understand how the unified procurement framework affects your professional advisory role regarding state tenders and compliance.
  • For your business: If your firm participates in public sector procurement, review the draft regulations to assess compliance risks, operational changes, and submit formal comments on provisions that may negatively impact your bidding processes before the 15 July 2026 deadline.
  • For your clients: Advise clients who supply goods or services to organs of state to evaluate the draft rules, particularly around preferential procurement and compliance requirements, to ensure their commercial strategies align with the upcoming 2026 regulatory regime.
