Brought to you by SA Legal Academy: Under the Competition Act, No. 89 of 1998, the Competition Commission has published draft guidelines on the repair, service, and maintenance aftermarkets for technical goods and invited written submissions from stakeholders.

The draft guidelines are intended to clarify the Commission’s enforcement approach regarding aftermarket practices, access to technical repair specifications, availability of replacement parts, and warranty restrictions imposed by original equipment manufacturers (OEMs).

Interested parties and affected stakeholders are invited to submit written comments on the draft guidelines by no later than 21 September 2026.

What this means for you, your business, or your clients

  • For yourself: Assess the evolving competition and right-to-repair regulatory framework to accurately advise commercial clients operating in technical goods, manufacturing, and maintenance sectors.
  • For your business: Audit your firm’s procurement, maintenance contracts, and warranty policies for technical equipment to ensure alignment with emerging aftermarket competition standards.
  • For your clients: Manufacturers, authorized service networks, and independent repair service providers must review the draft guidelines and file submissions by 21 September 2026 to address restrictive warranty terms, spare part distribution rules, and intellectual property access.
