Brought to you by SA Legal Academy: In accordance with parliamentary pre-tabling requirements, National Treasury has published the explanatory summary of the upcoming General Finance Laws Amendment Bill prior to its formal introduction in Parliament.

The Bill was approved by Cabinet on 29 July 2026 following public consultation on the draft version published in December 2025. It introduces critical statutory amendments across multiple regulatory frameworks, most notably the Financial Sector Regulation Act, No. 9 of 2017 and the Public Procurement Act, No. 28 of 2024.

Key Legislative Amendments

The proposed legislative adjustments focus on addressing operational impasses and expanding financial sector oversight:

  • Public Procurement Act, No. 28 of 2024: Amends section 68 regarding the statutory legislative review mechanism. Under the current wording, the Minister was required to conduct a comprehensive review within 24 months of its July 2024 publication — a timeframe that lapsed prior to the operationalisation of the Act. The amendment resets and refines ministerial review powers to support ongoing procurement reforms.
  • Financial Sector Regulation Act, No. 9 of 2017: Inserts a dedicated new Chapter into the Act to provide enhanced supervisory powers and regulatory mechanisms within the financial sector architecture.
