KZN Treasury Responds to Prudential Authority Liquidation Status on Ithala SOC Limited
Brought to you by SAnews: The KwaZulu-Natal Provincial Treasury has initiated stakeholder engagements following reports that the Prudential Authority has withdrawn its liquidation application against state-owned deposit-taking entity Ithala SOC Limited.
Under the regulatory framework governing deposit-taking institutions in terms of the Banks Act, No. 94 of 1990 and the Financial Sector Regulation Act, No. 9 of 2017, Ithala SOC Limited has been operating under the oversight of a court-appointed Repayment Administrator, Johan Kruger, tasked with managing repayment processes and safeguarding depositor assets.
Following reports of the Prudential Authority’s withdrawal of winding-up proceedings, KwaZulu-Natal Finance MEC Francois Rodgers confirmed that the provincial legal team is assessing the formal status of the court record. The Provincial Treasury has called for formal consultations involving national regulatory authorities, provincial government representatives, and Ithala management to address the following key regulatory and operational matters:
- Loan Portfolio Administration: Restoring operational control of Ithala’s primary loan book from the Repayment Administrator back to the institution to generate operating revenue.
- Insurance Revenue Realisation: Securing access to proceeds from Ithala’s insurance business lines to satisfy ongoing financial obligations and solvency requirements.
- Administrative Control: Reviewing the scope and necessity of the Repayment Administrator’s continued appointment to facilitate operational restructuring.
- Institutional Solvency and Compliance: Formulating a sustainable capitalisation and compliance pathway to preserve depositor value and financial inclusion services in KwaZulu-Natal.
