Madlanga Inquiry: Fourth Amendment to Terms of Reference Gazetted
Brought to you by SA Legal Academy: The Department of Justice & Constitutional Development has published a fourth amendment to the terms of reference governing the Commission of Inquiry into Criminality, Political Interference & Corruption in the Criminal Justice System (the Madlanga Inquiry).
Promulgated under the Commissions Act, No. 8 of 1947, the latest proclamation formally amends the inquiry’s operational timelines and replaces previously issued administrative targets. The gazetted notice effectively nullifies prior administrative dates issued in a Presidency media statement on 9 July 2026, which had proposed an evidence submission cutoff of 2 October 2026 and a final report deadline of 16 November 2026.
This regulatory adjustment follows earlier procedural amendments governing the Commission’s operational framework:
- August 2025: Gazetting of procedural regulations regarding search and seizure processes.
- June 2026: Regulatory amendment empowering persons authorised by the chairperson to issue binding administrative directives.
- Latest Proclamation: Formal extension of reporting deadlines and statutory alignment of submission terms in the Government Gazette.
