Brought to you by SAnews: In terms of section 2(1) of the Special Investigating Units and Special Tribunals Act, No. 74 of 1996, President Cyril Ramaphosa has published Proclamations 325 and 329 of 2026, authorising the Special Investigating Unit (SIU) to investigate alleged tender irregularities, overpayments, and maladministration in the Mangaung Metropolitan Municipality and the Gauteng Provincial Department of Health.

Proclamation 329 of 2026: Mangaung Metropolitan Municipality

Proclamation 329 of 2026 initiates an investigation into serious maladministration within the Mangaung Metropolitan Municipality in the Free State across nine specific contracts and overpayments reflected in the municipality’s annual financial statements for the financial year ending 30 June 2024.

The scope of the investigation focuses on:

  • The establishment and operationalisation of the Mangaung Metropolitan Municipal Police as published under Provincial Notice No. 124 of 2019;
  • Procurement and contracting for branding and marketing items, corporate gifts, catering services, and the upgrading, relocation, and configuration of office space at Gabriel Dichabe for the municipal police force;
  • Unauthorised, irregular, or fruitless and wasteful expenditure recorded in the municipality’s Fruitless and Wasteful Expenditure Register for the 2022–2023 and 2023–2024 financial years; and
  • Improper or unlawful conduct by officials, employees, service providers, or suppliers between 1 October 2016 and 31 July 2026, including contracts where payments were made but services were not rendered.

Proclamation 325 of 2026: Gauteng Department of Health

Proclamation 325 of 2026 authorises the SIU to investigate the procurement of voluntary medical male circumcision services by or on behalf of the Gauteng Provincial Department of Health under Tender No. GT/GDH/099/2018.

The investigation covers transactions occurring between 1 August 2018 and 31 July 2026, and will examine:

  • Whether procurement processes were fair, competitive, transparent, equitable, cost-effective, and compliant with section 217 of the Constitution and National or Provincial Treasury practice notes, circulars, and guidelines;
  • Unauthorised, irregular, or fruitless and wasteful expenditure incurred by the department or the State; and
  • Any connected unlawful conduct or non-performance by contractors preceding or following the specified period.
