Electoral Laws Amendment Bill: Public Submissions Called
Brought to you by SA Legal Academy: In terms of the National Assembly legislative process, the Portfolio Committee on Home Affairs has issued a notice calling for written public comments on the Electoral Laws Amendment Bill ahead of committee hearings.
The Bill was formally introduced and tabled in Parliament on 3 September 2026, following Cabinet approval granted on 29 July 2026. The proposed legislation introduces revisions across South Africa’s core statutory framework governing national, provincial, and local government elections.
The Bill proposes targeted amendments to three key statutes:
- Electoral Commission Act, No. 51 of 1996: Structural and administrative governance provisions regarding the Electoral Commission;
- Electoral Act, No. 73 of 1998: Operational, administrative, and ballot-access provisions governing general elections; and
- Local Government: Municipal Electoral Act, No. 27 of 2000: Revised criteria and requirements concerning the eligibility of registered political parties to contest local government elections.
Stakeholders and interested parties have until 30 November 2026 to lodge written submissions with the Committee Secretariat.
What this means for you, your business, or your clients
- For yourself: No direct individual compliance obligations; legal practitioners advising constitutional or public-interest entities must review the revisions to advise on ballot-access procedures.
- For your business: Professional advisory and public law practices should prepare submissions on behalf of affected entities before the 30 November 2026 deadline.
- For your clients: Registered political parties, municipal electoral candidates, and civic advocacy organisations must audit party registration standing and prepare for revised statutory contestation requirements.
