Electricity Regulation Amendment Bill: Notice of Intention to Table
Brought to you by SA Legal Academy: An explanatory summary of an intended Private Member’s Electricity Regulation Amendment Bill has been gazetted, initiating the formal public consultation process prior to tabling in Parliament.
Published in accordance with the Rules of the National Assembly, Democratic Alliance Member of Parliament Kevin Mileham has issued a pre-tabling notice setting out the scope and objectives of the proposed legislation amending the Electricity Regulation Act, No. 4 of 2006.
According to the explanatory summary, the draft Bill is intended to give practical and statutory effect to two recent judgments handed down in the High Court of South Africa (Gauteng Division, Pretoria). Key objectives outlined in the notice include:
- Aligning the statutory framework under the Electricity Regulation Act, No. 4 of 2006 with recent High Court rulings on regulatory powers and administrative authority;
- Addressing legal and operational barriers affecting electricity generation, reticulation, and procurement; and
- Providing statutory clarity for energy distributors and independent power producers following judicial determinations.
Interested parties and stakeholders are invited to submit written representations on the proposed legislative amendments. The deadline for public comment is 15 November 2026.
What this means for you, your business, or your clients
- For yourself: Legal and regulatory practitioners advising in the administrative and energy law sectors should review the explanatory summary to identify statutory adjustments stemming from the cited High Court decisions.
