Judicial Service Commission Calls for Comments on Consolidated Appointment Criteria and Procedures
Brought to you by SA Legal Academy: In terms of section 178 of the Constitution of the Republic of South Africa, 1996, read with the Judicial Service Commission Act, No. 9 of 1994, the Judicial Service Commission (JSC) has published draft consolidated criteria, guidelines, and procedures governing the appointment of judicial officers for public comment.
Interested parties and legal sector stakeholders have until 30 November 2026 to submit input on the draft proposals. According to an accompanying media statement, the consolidated document incorporates two revised sets of procedures previously published in draft form in August 2026, which were open for comment until 17 September 2026.
The consolidated framework seeks to establish codified procedural rules and uniform assessment metrics across the nomination and interview processes, including:
- Criteria and standards applied in assessing candidate suitability under section 174 of the Constitution;
- Procedural rules governing candidate screening, vetting, and interview protocols; and
- Processes regulating objections, public comments, and background submissions lodged against shortlisted nominees.
The JSC did not indicate in its statement whether earlier stakeholder representations submitted in response to the August 2026 drafts were incorporated into the current consolidated text now released for consultation.
What this means for you, your business, or your clients
- For yourself: Advocates, attorneys, and academics aspiring to judicial appointment must audit their professional profiles against the updated criteria and ensure compliance with newly formalised screening requirements ahead of future nomination rounds.
- For your business: Law firms, bar associations, and statutory legal bodies must review the draft framework and lodge formal submissions on appointment criteria and procedural transparency with the JSC before the 30 November 2026 closing date.
- For your clients: Commercial and institutional litigants gain greater transparency into the competency, vetting, and selection standards that determine judicial appointments across the High Court, Supreme Court of Appeal, and Constitutional Court.
