NCC Issues Draft Guidelines for CPA Opt-Out Registry Compliance
Brought to you by SA Accounting Academy: The National Consumer Commission (NCC) has issued draft guidelines governing compliance with the Opt-Out Registry regulations under the Consumer Protection Act, No. 68 of 2008 (CPA).
The draft guidelines outline operational requirements under the CPA Amendment Regulations of 2026, specifically addressing Regulation 4(7) and Regulation 4(11), read alongside Annexures N, O, and P. The framework formalises direct marketer registration protocols, annual renewals, mandatory monthly database cleansing, and strict adherence to consumer pre-emptive blocks.
Scope and Direct Marketer Obligations
Under the proposed regulatory mechanism, direct marketers engaged in electronic, telephonic, or direct promotional marketing must interface directly with the NCC Opt-Out Registry. Key operational obligations set out in the draft guidelines include:
- Compulsory NCC Registration: Formal registration of all direct marketing entities with the Commission, subject to prescribed registration and renewal fees.
- Monthly Database Cleansing: Mandatory monthly scrubbing of marketing and contact databases against the national Opt-Out Registry records before dispatching promotional communications.
- Recognition of Pre-emptive Blocks: Prohibition against communicating promotional offers to consumers who have logged pre-emptive blocks on the registry.
- Direct Marketer Identification: Full disclosure of sender identity and contact details in all marketing transmissions to allow audit verification.
The regulations apply across sectors conducting direct promotions, including financial institutions, insurers, retailers, estate agencies, motor vehicle dealerships, call centres, telemarketers, and digital marketing intermediaries.

What this means for you, your business, or your clients
- For yourself: You are entitled to register a binding pre-emptive block on the NCC Opt-Out Registry to prevent unsolicited promotional calls, SMSs, and electronic direct marketing.
- For your business: If your practice engages in direct marketing or client acquisition campaigns, ensure compliance systems are established to register with the NCC and cleanse prospective contact lists on a monthly cycle.
- For your clients: Commercial clients undertaking direct-to-consumer sales, brokerage, or financial promotions must budget for prescribed registry fees, integrate database cleansing protocols into their CRM software, and update compliance policies to prevent CPA enforcement notices and penalties.
