Sectional Titles Act: Amendments Under Electronic Deeds Registration Amendment Bill
Brought to you by SA Accounting Academy: The Electronic Deeds Registration and Recordal Systems Amendment Bill [B27-2026] proposes statutory amendments to the Sectional Titles Act, No. 95 of 1986, aligning sectional title conveyancing and recordal procedures with the Electronic Deeds Registration and Recordal Systems Act, No. 19 of 2019.
Under the proposed amendments, the statutory framework of the Sectional Titles Act, No. 95 of 1986 is extended to recognise electronic deeds, plans, and related conveyancing documentation. The Bill establishes the formal legal mechanism to transition the deeds registries from paper-based processing to an integrated digital registry system.
The key regulatory changes introduced by the Bill across sectional title administration include:
- Enabling the preparation, electronic execution, lodgment, and formal registration of deeds of transfer, mortgage bonds, and sectional title units via the digital registry system;
- Authorising the electronic submission, examination, and recordal of draft sectional plans and sectional scheme registrations;
- Extending legal recognition, electronic signature validity, and digital verification standards to conveyancing practitioners, surveyors, and deeds registry officials operating under the statutory system; and
- Aligning terminology, record retention rules, and registry search provisions across the Sectional Titles Act, No. 95 of 1986 and the Electronic Deeds Registration and Recordal Systems Act, No. 19 of 2019.
