Brought to you by SA Legal Academy: The Department of Justice & Constitutional Development has issued a second pre-tabling notice for the Extradition Bill, marking a procedural step toward its formal introduction in Parliament.

In terms of the Rules of the National Assembly, the Department gazetted the notice as the Bill’s procedurally required pre-tabling explanatory summary. This follows a previous, less detailed notice published approximately nine months ago. The latest notice signals the imminent tabling of the legislation, which is intended to modernise the current extradition framework.

According to the notice, the Extradition Bill seeks to achieve the following:

  • Align domestic legislation with South Africa’s international treaties and obligations.
  • Provide an updated legal framework for the extradition of persons between South Africa and foreign states.

What this means for you, your business, or your clients

  • For yourself: No direct individual obligations; impact is channelled through professional advisory roles in international criminal and administrative law.
  • For your business: Legal practices and compliance firms must monitor the Bill’s progression through Parliament to update internal protocols for handling cross-border legal assistance and extradition requests.
  • For your clients: Clients with international operations or those subject to cross-border legal proceedings should be advised that the surrender process will soon be governed by a revised framework aligned with international treaty standards.
