Extradition Bill Tabled in Parliament to Replace 1962 Act
Brought to you by SA Legal Academy: Parliamentary papers have confirmed that the long-awaited Extradition Bill has been officially tabled in Parliament. The proposed legislation initiates the process to reform South Africa’s international judicial cooperation framework.
The tabling of the Bill follows more than a year after it received Cabinet approval. Once passed by Parliament, enacted, and operationalised, the new statute will repeal and replace the outdated Extradition Act, No. 67 of 1962.
The legislative overhaul is underpinned by constitutional imperatives and aims to align South Africa’s extradition procedures with various Constitutional Court judgments. The new framework is expected to modernise extradition proceedings, clarify the roles of the judiciary and the executive, and ensure compliance with international treaty obligations.
